1. Who we are

Goony.ai is an independent 18+ AI roleplay service. All characters are fictional and portrayed as adults; conversations, images and voices are AI-generated and feature no real people. Characters imported from community catalogues (such as chub.ai) remain the property of their creators.

2. Adults only

The Site contains explicit adult content. You must be at least 18 years old — or the age of majority where you live, whichever is higher — to create an account or browse it, and accessing adult content must be legal where you are. By using Goony.ai you confirm that you meet these requirements. We may ask for proof of age at any time and suspend the account until it is provided.

3. Your account

You are responsible for your credentials and for everything done through your account, whether by you or by anyone you let use it. Keep your password private and tell us if you suspect misuse. One person may hold one account; accounts opened to evade a suspension are closed on sight.

4. Your content and your generations

"Your Content" means everything you upload, write or request on the Site: fan art and videos you submit, comments and posts, character sheets and personas you create or import, chat messages, image and voice requests, Studio treatments and cast uploads, and any other prompt or input. "Your Generations" means the images, videos, voices and text that the Site's AI models produce at your request — from your prompts, your characters, your uploads or your choices.

You are solely responsible for Your Content and Your Generations. The models are tools that execute your instructions; what you ask for, what you make with them and what you do with the result are your decisions and your liability. You represent and warrant that:

• you own Your Content or hold every right, licence and consent needed to submit it and to have it processed by AI models;
• Your Content and Your Generations depict fictional characters portrayed as adults only, and never a minor or a real, identifiable person — a reference photo you upload must not be of a real person unless that person is you, an adult, and you consent;
• Your Content and Your Generations are legal where you live and where you use them, and infringe no copyright, trademark, privacy, publicity or other right of anyone;
• you will not use Your Generations to harass, defame, deceive or impersonate anyone, nor present them as real events or real people.

You keep whatever rights you hold in Your Content and, to the extent the law allows, in Your Generations. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, process, display and distribute them as needed to run, moderate, secure and promote the Site. Submissions to public galleries are reviewed before publication; chats, generations and Studio productions are private to your account unless you publish them. We may remove anything, at any time, at our discretion.

5. Prohibited content and conduct

You must not submit, request, generate, publish or attempt to obtain on the Site:

• any sexual content involving a minor — real, fictional, drawn, stylised, "aged up", implied or described as such. Every character must be an adult, full stop;
• sexual or intimate depictions of a real, identifiable person without that person's consent, including deepfakes, look-alikes of public figures and content built from someone else's photos;
• non-consensual, coerced or otherwise illegal sexual content presented as real, and anything that facilitates a crime;
• content that infringes third-party rights, malware, spam, scraping, harassment, doxxing, threats, fraud or impersonation.

You must not try to bypass, probe or defeat the Site's safety filters, age gate or moderation — including by rephrasing, misspelling, encoding or splitting a request. A request blocked by a filter is a warning, not a puzzle.

6. How AI generation works — and what we do not do

Chat replies, voices, images and videos are produced automatically by probabilistic models at the moment you ask for them. Nobody at Goony.ai reviews a generation before it reaches you. We run automated screening on requests, keep human moderation after the fact and act on every report, but automated screening is imperfect in both directions: it can refuse a legitimate request and it can miss a prohibited one. A generation reaching you is therefore not our approval of it.

Generations are parody and fiction. They are not real people speaking or acting, they do not represent the views of any actor, character, studio or rights holder, and they may be inaccurate, unexpected or offensive. We do not guarantee any particular output, and a request we refuse, cancel or filter is not a fault of the service. We keep a log of generation requests (prompt, model, time, account) to enforce these terms, resolve billing disputes and meet legal obligations.

7. Our role, notices and law enforcement

For content that users submit, publish or generate, Goony.ai acts as a hosting intermediary within the meaning of Regulation (EU) 2022/2065 (Digital Services Act) and the applicable e-commerce rules: we store and transmit it at your request and do not author it. We are not liable for such content as long as we have no actual knowledge of its illegality and, once we do, we remove or disable access to it promptly. Anyone can report content by writing to [email protected] with the URL and the reason; the DMCA & removal page describes what a notice must contain.

Where the law requires it, illegal content — above all any sexual depiction of a minor — is not simply deleted: the material, the request that produced it and the account data behind it are preserved in a restricted quarantine and reported to the competent authorities (PHAROS in France, NCMEC in the United States, or the equivalent where you are). We cooperate with lawful requests from authorities and may disclose account data to them.

8. Credits, subscriptions and payments

Credits are a virtual currency with no cash value, usable only on the Site. They are non-refundable except where the law requires otherwise. Subscriptions paid by card renew automatically at the end of each period until you cancel them from your account; the period already paid for runs to its end. Subscriptions paid with crypto or credits run for the period shown at purchase and do not renew. Credits, subscriptions and Studio productions are sold and processed by eroq.ai, the network's merchant of record, whose terms of sale govern the payment, the right of withdrawal and money refunds. Credits on an account closed for a breach of section 5 are forfeited.

9. Copyright and removal requests

If you believe content on the Site infringes your rights or depicts you without consent, follow the DMCA & removal procedure or write to [email protected]. Valid notices are acted on promptly and repeat infringers lose access.

10. Enforcement

We may refuse a request, remove content, cancel a production, restrict features, and suspend or close an account, with or without notice, whenever we believe these terms or the law are being broken. A breach of section 5 leads to immediate closure, forfeiture of credits and paid periods, and, where the law provides, a report to the authorities. We may also refuse service to anyone, for any lawful reason.

11. Indemnification

You agree to indemnify, defend and hold harmless Goony.ai, its operator, affiliates, officers, staff and contractors from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising from Your Content, Your Generations, your use of the Site, your breach of these terms or your violation of any law or third-party right. This obligation survives the closure of your account.

12. No warranty and limitation of liability

The Site and its generations are provided "as is" and "as available", without warranty of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits or data, or reputational harm, and our aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding it. Nothing in these terms excludes liability that cannot be excluded under the mandatory law of your country of residence.

13. Governing law

These terms are governed by French law. Disputes go to the competent courts of Paris, France, subject to the mandatory consumer-protection and jurisdiction rules of your country of residence. EU consumers may also use the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr).

14. Changes and contact

We may update these terms; the date above always reflects the current version and material changes are announced on the Site. Continuing to use Goony.ai after a change means you accept it.
